The defendant in error, as plaintiff, instituted this action against the plaintiff in error, as defendant, in the district court of Oaddo county. The parties will be referred to as they appeared in the trial court.

The plaintiff alleges in his petition that he is the duly appointed, qualified, and acting administrator of the estate of J. M. Youngblood, deceased; that on July 8, 1925, and for a long time prior thereto', the deceased, J. M.
