The plaintiff in error, as plaintiff below, sued the defendant in error, as defendant, for a balance alleged to be due on the purchase price of a certain 35-volume set of books, alleging that the same had been sold, delivered, and accepted under the terms of a certain written order there.for, and which is as follows:
