Appellant Luis Felipe Rodriguez, Jr. appeals his conviction for operating a motor vehicle while intoxicated, misdemeanor repetition. See Tex. PemCode Ann. §§ 49.04, .09(a) (West Supp.2002). 1 The jury found appellant guilty and the trial court assessed his punishment at forty-five days’ confinement in the county jail and a fine of $1,000.
