Judicial Watch Incorporated (“Judicial Watch”) has sued the United States Department of Homeland Security (“DHS”), the Department of Justice (“DOJ”) and the State Department (“DOS”) pursuant to the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552, et seq., seeking to compel the disclosure of documents relating to the prosecution of two United States Border Patrol agents. Currently before the Court is Judicial Watch’s motion for a preliminary injunction seeking the immediate release of certain documents from DOJ. 1 For the following reasons,…
