This cause comes before the court on the motions of the RD/RA Settling Defendants 1 for partial summary judgment on Count 1 of their complaint on the issue of liability and for leave to file a statement of genuine issues instanter, and the motions of plaintiffs Akzo Coatings, Inc. (“Akzo”) and O’Brien Corporation (“O’Brien”) for summary judgment and for oral argument.
