*1253Appeal and cross appeal from an order of the Supreme Court, Erie County (Eugene M. Fahey J.), entered May 17, 2006. The order granted defendants’ motion to dismiss the complaint on the grounds that two causes of action were time-barred and the third cause of action was duplicative of one of the two causes of action.

It is hereby ordered that said cross appeal be and the same hereby is unanimously dismissed and the order is modified on the law by denying the motion in part and reinstating the breach of fiduciary duty cause of action insofar as it is based on events occurring after October 7,…
