Plaintiff appeals from a judgment against him in an action for declaratory relief by which he seeks to determine his right to promotion from foreman janitor to head janitor in the Civil Service System of the City and County of San Francisco. The plaintiff and two others took a promotional examination given on April 7, 1939, to establish an eligible list for the position of head janitor. Plaintiff placed third.
