MEMORANDUM-DECISION AND ORDER

SHARPE, District Judge.

I. Introduction

Plaintiffs Amanda Bain and Robert Cantwell (herein Bain) bring this action, pursuant to 42 U.S.C. § 1983, challenging the Town of Argyle’s revocation of their building permits. See Dkt. No. I. 1 The court previously denied defendants’ motion to dismiss and held that Bain’s complaint sufficiently plead a cause of action based on the Town’s revocation policies.
