Plaintiff pedestrian brought this action to recover for personal injuries resulting from being struck by an automobile driven by the defendant. The plaintiff’s allegations of negligence were denied by the defendant, who by affirmative pleading raised the defense of contributory negligence. Trial before the court and a jury resulted in verdict for the plaintiff. The court denied the defendant’s motion for judgment non obstante veredicto and, by a general order, granted a new trial.
