The parties will be designated as in the trial court." This was an action upon a promissory note against defendant, Elliott, as indorser, commenced in the justice court. Judgment was for the plaintiff, and defendant appealed to the county court, and judgment was there also rendered for plaintiff, and now defendant prosecutes his appeal to this court.
In his bill of particulars the plaintiff alleged that before maturity, for a valuable consideration, the defendant assigned, indorsed, and delivered the note sued on to him, and' that at maturity he presented the note to the…
