Plaintiff Cathy T. DiPaulo (“DiPaulo”) brings this action against John Potter in his representative capacity as Postmaster General of the United States Postal Ser vice (“USPS”) under the Rehabilitation Act of 1973 (“Rehabilitation Act”), 29 U.S.C. § 791 et seq. and the Americans with Disabilities Act of 1990 (“ADA”), 42 U.S.C. § 12101 et seq., alleging claims of mental disability discrimination.
