This appeal arises from a denial by the district court of Lincoln county of a motion filed by the petitioner, Thomas E. Baier, pursuant to the provisions of K. S. A. 60-1507.

On February 5, 1964, a complaint was filed in Lincoln county court charging petitioner with forgery in the second degree (G. S. 1949, 21-608, now K. S. A. 21-608) and a warrant was issued for his arrest. Later on the same date Baier was apprehended in Rice county and returned to Lincoln county.
