This is an appeal by the state from an order granting the defendant’s motion for dismissal of an information charging aggravated arson (K. S. A. 21-3719 [Weeks]).

At issue are the constitutional and statutory guarantees of a right to speedy trial.

On April 9, 1973, apartment building “L” of the Countryside Rentals, occupied by two females, was damaged by a fire set by some arsonist. On April 10, 1973, Timothy Fink (defendant-appellee ) was arrested and charged by way of complaint with aggravated arson (K. S. A. 21-3719). That same day the…
