This is an appeal from a denial of a motion filed under the provisions of K. S. A. 60-1507 in the district court of Jewell county.

On December 10, 1962, the petitioner, Wilbur Edward Allen, was charged in the county court of Jewell county with the crime, of murder in the first degree (G. S. 1949 [now K. S. A.] 21-401) for the death of one, John Maxwell.
