sitting in place of MR. JUSTICE REYNOLDS, disqualified, delivered the opinion of the court.

Plaintiff: brought this action to recover damages for personal injuries suffered by him during his employment as a section-hand for the Northern Pacific Railway Company. The injury pleaded was a relaxation of the left inguinal ring, left side and back, and left lower part of the abdomen.
