This is an appeal by plaintiff below from the judgment and orders of the trial court entered on October 25, 1961, sustaining defendant’s demurrer to count one of plaintiff’s first amended petition (hereafter referred to as the petition), refusing to give plaintiff’s requested instructions, giving improper instructions, permitting defendant to amend its answer, entering judgment in favor of defendant, approving answers to special questions, and overruling plaintiff’s post-trial motions (1) to vacate and for new trial (2) for directed verdict…
