We will refer to the plaintiff in error as the defendant and to the defendant in error as plaintiff as they appeared in the trial court.

The original complaint in this action was filed in the County Court of Arapahoe County, resulting in a judgment in favor of the plaintiff. On appeal to the District Court of said county, there was a trial de novo to the court, which entered findings of fact and conclusions of law in favor of plaintiff’s claim.
