This case, a resurrection of proceedings before the court in the late 1980s, is before the court after argument on defendant’s dis-positive motion. Following the filing of plaintiffs’ amended complaint on August 10, 2006, defendant moved to dismiss pursuant to RCFC 12(b)(1) and 12(b)(6). The instant case, along with its companion, People of Bikini v.
