On August 23, 2011, plaintiff, Allen Cooper, filed a complaint in this court asserting a variety of claims against defendant, the United States (docket entry 1). In response, defendant filed a motion to dismiss pursuant to Rules 12(b)(1) and 12(b)(6) of the Rules of the Court of Federal Claims (“RCFC”) contending that the court lacks jurisdiction to hear plaintiffs claims and, alternatively, that plaintiff has not asserted a claim upon which relief can be granted (docket entry 4, Oct. 24, 2011).
