MEMORANDUM AND ORDER

MILLER, District Judge.

This cause is before the court on separate summary judgment motions filed by defendants Allied Corporation, Burlington Northern Railroad Co. (“Burlington”), and General Electric Railcar Services Corp. (“GERSCO”). Fed.R.Civ.P. 56. The plaintiff, Consolidated Rail Corporation (“Conrail”), has filed a response and the defendants their replies. 28 U.S.C. § 1332 provides jurisdiction over the subject matter of this action.
