After exhausting his administrative remedies, Henry Lujan brought this action against the New Mexico Health and Social Services Department (Department) alleging discrimination and retaliation in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. He appeals the district court’s judgment in favor of the Department. The Department cross-appeals the district court’s refusal to award it attorneys fees as the prevailing party and, in addition, asks this court to award it attorneys fees and costs of the appeal under 42 U.S.C. § 2000e-5(k) and…
