ORDER
MARTIN, District Judge.
Plaintiff College Park Holdings, LLC (“CPH”) filed suit against defendant Race-Trac Petroleum, Inc. (“RaceTrae”), alleging violations of the Resource Conservation and Recovery Act (“RCRA”), 42 U.S.C. §§ 6901-6992k, as well as various state statutes. CPH claims that a petroleum release at RaceTrac’s gasoline service station (the “Service Station Property”) contaminated CPH’s adjacent property on which it operates a Radisson Hotel (the “Hotel Property”).
