Plaintiff City of Evanston has sued Defendants Northern Illinois Gas Company (“Nieor”) and Commonwealth Edison Company (“ComEd”), alleging violations of the Resource Conservation and Recovery Act (“RCRA”), 42 U.S.C. §§ 6901 et seq. (Count I). In addition to its RCRA claim, Plaintiff brings a variety of state and municipal claims, including a claim for violations of Evanston Code of Ordinances § 9-12-1 et seq.
