This is an appeal by the executor of the estate of Katherine E. Swift, deceased, from a judgment allowing appellee’s claim for $5,250 against the estate. The case was heard by the court, without a jury.

The claim of the appellee was originally filed in the probate court and upon a hearing in that court was alloAved. The executor appealed and the case was tried de novo in the circuit court, by the court, without a jury. The claim was again allowed and the appellant appealed to this court.
