This action was originally commenced before a justice .of the peace, and hence there are no written pleadings in the cause, and all defenses, including the statute of frauds, maybe regarded as having been pleaded. An appeal was prosecuted from the judgment of the justice to the circuit court, where a trial de novo Avas had, which resulted in a judgment for the appellee.
It is insisted that the verdict is against the Aveight of the evidence, and Ave are asked to review the evidence, to ascertain Avhether it sufficiently sustains the finding of the jury. It is not the duty of this court to enter…
