A petition filed by the Board of Trustees of the Town of Thomas with the county commissioners of Custer county, praying for annexation of certain territory to the town, was dismissed on motions filed by A. A joint judgment was entered against remon-strators on appeal to the superior court, and remonstrators other than the railway company bring error.

On the 7th day of November, 1911, the board of trustees of the town of Thomas filed a petition before the board of county commissioners of Custer county, praying for the annexation of certain contiguous territory to the town. On December 12, 1911, the Kansas City, Mexico & Orient Railway Company, through their attorneys, filed an objection to the jurisdiction of the board of county commissioners, alleging that no notice had been given by the petitioners as required by law.
