This case is before the Court on the parties’ cross-motions for summary judgment on liability. Plaintiff, SUFI Network Services, Inc. (“SUFI”) is seeking the recovery of attorneys’ fees, expenses, and interest that it incurred following the Government’s material breach of a contract for telephone services performed in Germany. The contract in*188volves an Air Force non-appropriated funds instrumentality in which neither the Contract Disputes Act (“CDA”) nor the Federal Acquisition Regulation (“FAR”) applies.
