In this pre-award protest, Plaintiff, American Safety Council, Inc. (“ASC”) challenges the terms of a request for proposals from the U.S. Department of Labor (“DOL”), Occupational Safety and Health Administration (“OSHA”). The Solicitation sought proposals for its Online Outreach Training Program. The Protest challenges the Solicitation’s terms as being unduly restrictive, inconsistent with customary commercial practice, ambiguous, and failing to address a conflict of interest. 2 As a result, ASC contends that the Court must enjoin OSHA from disrupting the…
