MEMORANDUM AND ORDER
LUNGSTRUM, District Judge.
Plaintiff Steven A. Martin filed suit against the State of Kansas alleging violations of the Americans with Disabilities Act (ADA) arising out of his employment with the Department of Corrections. This matter is presently before the court on defendant’s motion for summary judgment (Doe. # 56).
Mr. Martin alleges the State of Kansas discriminated against him on the basis of both an actual disability and a perceived disability in violation of the ADA. He also alleges that two policies of the State violate the ADA. First, Mr. Martin claims that the…
