Robert Arevalo sued the United States under the Federal Tort Claims Act (FTCA), 28 U.S.C. §§ 2671-2680. He also sued Chuck Woods, an Immigration and Naturalization Service (INS) Investigator, under the constitutional tort theory of Bivens v. Six Unknown Named Agents of the Federal Bureau of Narcotics, 403 U.S. 388, 91 S.Ct. 1999, 29 L.Ed.2d 619 (1971). 1 Both claims arose out of the same detention and treatment of Arevalo by Investigator Woods.
