This is an appeal from an order of the District Court of St. Louis County denying the motion of the state to dismiss the appeal of a landowner from an award of commissioners appointed to assess damages in a condemnation proceeding for lack of jurisdiction.

Originally, the State of Minnesota commenced two separate condemnation proceedings, one involving the acquisition of certain land for right-of-way purposes for Trunk Highway No. 61 and the other involving the acquisition of land for right-of-way purposes for Trunk Highway No. 281.
