Riverwalk CY Hotel Partners, Ltd. sued Akin Gump Strauss Hauer & Feld, LLP for legal malpractice, asserting both breach of fiduciary duty and negligence claims. The trial court granted Akin Gump’s motion for a partial summary judgment on Riverwalk’s breach of fiduciary duty claim. The motion asserted that Riverwalk could not “fracture” its legal malpractice claim into an additional cause of action for breach of fiduciary duty.
