This case is before the Court on a remand from the Federal Circuit. Plaintiff, Robert 0. Mudge, seeks back pay he alleges is owed for his service from 1990 through 1995 as an employee of the Federal Aviation Administration (“FAA”). Prior proceedings led to a decision by this Court dismissing Mr. Mudge’s complaint for lack of jurisdiction and then to a reversal by the Federal Circuit and a remand to this Court. See Mudge v.
