VERTEFEUILLE, J.
The plaintiff, First Union National Bank, brought this action to foreclose municipal tax hens recorded against a property in Bridgeport that is owned by the defendant state of Connecticut (state)1 and is used as part of the campus of Housatonic *289Community College. The state appeals from the trial court’s denial of its motion to dismiss, in which it claimed that General Statutes § 49-312 does not waive sovereign immunity so as to permit the foreclosure of the state’s ownership of real property.
