The Empire Coal and Coke Companj^ a corporation organized and doing business under the laws of the State of West Virginia brought its action of assumpsit in the circuit court of Mercer County against Hull Coal and Coke Company, a corporation organized under the laws of the State of Kentucky and doing business in Said county of Mercer.
