McWhohteR, Judge:

In an action for trespass on the case W. H. Hannnm recovered a judgment against the Petersburg and Pranldin Telephone Company, a partnership composed of various parties, for four thousand, five hundred dollars for personal injuries to plaintiff. The defendants obtained a writ of error from the said judgment. The first error assigned is the overruling of the demurrer to plaintiff’s declaration.
