Writ of error to a judgment of the circuit court of Cabell county for $350.00 in favor of Charles H. Humphreys, in an action of trespass on the case brought by him against the Newport News & M. Y. Company. The declaration alleged that the defendant was a corporation under the laws of the state of Connecticut, doing business in the states of Kentucky and West Yirginia; that the defendant leased and operated a railroad called the “Elizabethtown, Lexington & Big Sandy Railroad,” extending from Catlettsburg, in Ken tucky, to Lexington, in Kentucky; that plaintiff was in the service…
