By this proceeding in mandamus the petitioner seeks to compel the dismissal of a certain criminal prosecution initiated by the filing of an indictment against her on November 10, 1927. On November 16, 1927, the petitioner entered a plea of not guilty, and the cause was set for trial on December 12, 1927. The record of the court below is silent as to what occurred on the day fixed for trial. It is agreed, however, that neither side had applied for a continuance ; but it is a fact that on December 12th, and for several days thereafter, the petitioner was actually being tried on another and…
