The suit was to collect the local rate of 20$ per hundred pounds on shipments of 35 carloads of rough hardwood lumber, shipped from Woodville, Miss, and delivered to defendant at Alexandria, La., on varying dates from September 12, 1942, through May, 1943.

The claim was: that, under the provisions of Rough Material Tariff 140.1 I.CJC. No. 1540, the shipments of rough lumber moved under, and plaintiff had collected from defendant, the net transit rate of 12$ per hundred pounds; that defendant, as to each of such shipments, having failed to reship the manufactured…
