This action was originally begun in the district court of Muskogee county, Okla., by the-First National Bank of Muskoge'e to recover certain taxes paid under protest.-
In the trial of the case below the court found the issues in favor of the plaintiff and rendered judgment in its favor. From said judgment the defendant prosecutes an appeal in this court. For convenience, the parties will b’e referred to as they appeared in the court below.
