This action was brought by the plaintiff in error to recover from the county treasurer of Oklahoma county certain taxes paid under protest for the year 1922. The defendant filed a demurrer to plaintiff’s petition, which demurrer was sustained as to causes. of action numbered three, four, six, and seven. The demurrer was overruled as to the other causes of action. The case was tried and a judgment rendered for the defendant on the first and second causes of action and for the plaintiff on the fifth cause of action.
