BRADLEY, Judge.

This is a workmen’s compensation case, and the review here is by certiorari.

*69The respondent here, Herman Jones— hereinafter referred to as Jones — filed a complaint against the petitioner here, M. R. Thomason and Associates, Inc. — hereinafter referred to as Thomason — in the Circuit Court of Jefferson County, Bessemer Division, alleging that while acting \yithin the scope of his employment with Thomason he was injured in a bulldozer accident and as a proximate result of that accident he was totally disabled.
