OPINION

Before RABINOWITZ, C. J., CON-NOR and BOOCHEVER, JJ., and DIMOND, J. Pro Tern. RABINOWITZ, Chief Justice.

This matter arises out of the superior court’s dismissal of appellant’s complaint for failure to state a claim upon which relief can be granted.

In his complaint appellant made in part the following allegations. In 1964 another named defendant, Ugiss, designed, constructed, and was the owner of a certain apartment building in Anchorage.
