In this action the appellee, asplaintiff, sued the appellant and one William H. Taggart, as defendants, upon a promissory note, of which the following is a copy :
“$1,000.00. Franklin, Aug. 7th, 1874.
“Twelve months after date we promise to pay to the order of William H. McCoy one thousand dollars, with in*328terest at the rate of ten per cent, per annum, value received, without any relief whatever from valuation or appraisement laws. If this note be collected by suit, the judgment shall include a reasonable fee of plaintiff’s attorney, and shall bear ten per-cent, interest.
