OPINION & ORDER

DOMINGUEZ, District Judge.

Pending before the Court is Third Party Defendant’s, United States Small Business Administration (hereinafter referred to as “SBA”), Motion to Dismiss the Third Party Complaint for failure to state a claim upon which relief may be granted, pursuant to Fed.R.Civ.P. 12(b)(6). Said motion was filed on January 17, 2003. (Docket No. 8). Third Party Defendant alleges that the Third Party Complaint fails to state a claim against SBA because it fails to describe a breach of any duty, express or implied, which SBA purportedly owed to the Third Party Plaintiffs.…
