MEMORANDUM OF DECISION

This adversary proceeding was initiated by the Complaint Seeking Damages in Core Adversary Proceeding (“Complaint”) filed by Debra L. Miller, Chapter 13 Trustee (“Trustee”), and Dale Thomas Laskow-ski, chapter 13 debtor (“debtor”), against Ameriquest Mortgage Company (“Ameri-quest”), defendant herein. Presently before the court is Ameriquest’s Motion to Dismiss. After considering the motion, briefs, memoranda and responses of the parties, the court took the matter under advisement.
