The complaint in this action alleges that on May 8, 1915, the defendant sold to plaintiff 1,000 shares of stock in a mining company, of which the defendant was then an officer and director, for the sum of $1,000, and, as an inducement for the purchase of the same by the plaintiff, “represented and guaranteed” to plaintiff that he would receive dividends thereon within three years from the date of purchase amounting to at least the sum of $1,000, and interest thereon at the rate of eight per cent per annum until paid; that on said date “as evidence of said guaranty” the defendant executed and…
