OPINION

ALLEGRA, Judge.

This military pay case is before the court on defendant’s motion for judgment on the administrative record. Plaintiffs spouse is a former sergeant in the United States Army who received severe and permanent injuries in a car accident. The Army determined that the accident was the result of voluntary intoxication and denied plaintiffs spouse disability retirement and benefits.
