The basic issues raised in each of these thirty-four cases are the same. Each appellant was subpoened to appear before the Mahoning County September Grand Jury; each appeared and, after answering certain preliminary questions, refused to answer others on the ground that his answer “may tend to incriminate me under the Fifth and Fourteenth Amendments to the United States Constitution and Article I, Section 10 of the Constitution of Ohio.” In each case the prosecuting attorney caused the Court of Common Pleas (Rigelhaupt, J.) to be informed of the interrogatories, the refusal and the excuse…
