In this “rails-to-trails” case, Plaintiffs have filed a motion for reconsideration and/or clarification of the court’s June 24, 2011, opinion (“Pis.’ Mot.”) finding Defendant liable for a taking of Plaintiffs’ property but only for the periods beginning with the issuance of the first NITU through the expiration of a series of NITUs regarding either of the two rail corridors at issue.
